  DESCRIPTION  
  Unlike many other jurisdictions, 'pay when paid' and 'pay if paid' provisions are not prohibited in Hong Kong. If a subcontract contains a 'pay when paid' provision, the subcontractor's right to payment will not arise until the main contractor has received the relevant payment from the employer. A 'pay if paid' clause on the other hand makes payment to the main contractor a condition precedent to the subsequent on-payment to a subcontractor.
