For buildings governed by the Buildings Ordinance (Cap. 123), an occupation permit (OP) is required before a building can be occupied. To obtain an OP, the Building Authority must be satisfied that the building or the relevant part (if a temporary occupation permit (TOP) is requested) has been constructed in accordance with the Buildings Ordinance. Importantly, obtaining an OP in Hong Kong does not automatically mean that 'practical' or 'substantial' completion of the works has been achieved under a building contract. |
